There are more than 2.2 million people now confined in American prisons and
jails, and yet, in [the author's] view, the criminal justice system is not
only“oppressive” but also “inadequate.”

"And yet"?! How does the fact that there are more than 2.2 million people
now confined in American prisons and jails contradict the claim that the
criminal justice system is not only“oppressive” but also “inadequate”?

OTOH, props to the writer for using "but *also*" and not merely "but."
