Language law invalidated in Ivano-Frankivsk region

At the special session on October 9, the Ivano-Frankivsk Regional
Council dismissed the protest of acting regional prosecutor Volodymyr
Havryushenko against paragraph 1 of the decision of the Regional
Council of August 23, 2012 on compliance with the Constitution of
Ukraine concerning the functioning of the state Ukrainian language in
Ivano-Frankivsk region.

In its protest, the prosecutor demanded to cancel the paragraph 1 of
the decision of the Regional Council, which invalidates the law of
Ukraine on principles of national language policy in Ivano-Frankivsk
region.

Prosecutor pointed to the fact that by taking this decision, the
Ivano-Frankivsk Regional Council went beyond its powers under Article
43 of the law on local self-government in Ukraine and violated the
requirements of Art. 19 of the Constitution, which requires local
authorities to act within the powers and in the way prescribed by the
Constitution of Ukraine and laws of Ukraine.

Skripnychuk pointed out that, under the Constitution, the state
language is Ukrainian, and, on this basis, it is a part of the
constitutional order.
