Abstract:

A linguistic approach to legal texts offers some perspective about
interpretive possibilities for contested technical terms. This
text-and-discourse oriented approach is particularly illuminating for the
analysis of communication between international and national laws, because
here the linguistic constitution of facticity is often fought over with
increasing intensity: this work investigates the processes of negotiation in
nation-state sovereignty and shifts in legal competence based on a typology of
speech acts. Verbally cluttered lines of conflict, which are characterized as
semantic conflicts, are here emphasized in the processes of harmonizing
national law and international law. The custody battle of "Görgulu" serves as
an example of the problems in lines of communication. Through the
investigation of technical discourses and their transformation in medial
texts, the problem of communication can be exposed, which helps to promote
transparency in the representation of facticity as conceived by state
