les liens entre langue et droit ont souvent été considérés comme allant de soi
(à travers des adages comme « Le droit a besoin de la langue pour
exister »), leur étude précise et approfondie ne peut se faire ni au sein
des seules sciences juridiques, ni au sein des seules sciences du langage. Dans
cet évident contexte de dialogue des disciplines, le présent colloque souhaiterait
donc interroger la contribution de la recherche francophone non seulement à
l’intérieur de la ‘jurilinguistique’, mais de façon plus large dans toutes les
disciplines – ou plutôt : à l’intersection entre toutes les disciplines –
ayant pour objet l’étude des discours juridiques au sens large, sans exclusive
d’écoles ou d’approches théoriques et méthodologiques.<o></o></p>

des tendances de la recherche actuelle sur ce sujet, l’accent sera mis sur les 4

pragmatiques des discours juridiques :</b> si la théorie des Actes de
Langage, en particulier à travers la catégorie de la performativité, est
généralement convoquée <i>par principe</i>
pour l’approche discursive du droit, des analyses concrètes et empiriquement fondées
sont encore nécessaires dans plusieurs domaines, par exemple au niveau de
l’expression des modalités déontiques (le permis et l’interdit, l’obligation et

d’appeler l’interaction juridique. Ces interrogations pourront amener à aborder
la question des modes et des limites de l’interprétation des discours
juridiques et à considérer leur inscription au sein de la catégorie des
discours constituants. Par ailleurs, bien que le langage juridique soit censé
exprimer des concepts précis, il comporte des concepts vagues, qui ne peuvent
être définis. En droit tunisien, le discours juridique contient des
« notions floues » telles que <i>bon goût, bon père de famille,
bonnes mœurs, bonne foi, intérêt, ordre public, …</i>Ces notions floues
relèvent d’un paradoxe : les termes plus précis sont moins confus et en
même temps moins avantageux, les termes vagues ne constituent pourtant pas une
entrave à la compréhension, mais ils concurrent à la bonne réalisation du
droit.L’inintelligibilité et l'obscurité des normes juridiques est-elle à
l’origine de l'ineffectivité ou l'inefficacité de l'action

abordant les discours juridiques à travers l’angle terminologique et
phraséologique, on s’intéressera à leur possible étude en termes de formules
permettant d’éclairer d’un jour nouveau nombre de problématiques
discursives : typologie de ces discours, théorie des genres oratoires,
accessibilité des contenus, etc. Ce sera aussi l’occasion, dans des études
