OED's "pirating" has a gap from 1884 to 1968. This is an interesting cite.

In what was described as the first major court action to stop the widespread "pirating" of phonograph records, Columbia Records, Inc., and Louis Armstrong, the trumpeter and band leader, have filed a complaint in the New York Supreme Court directed against Paradox Industries, Inc., and its president Dante Bolletino, who issue records under the Jolly Roger label.
