The Washington Post also covers this suit today, at http://www.washingtonpost.com/wp-dyn/articles/A46985-2003Aug11.html. Here's Fox's key allegation and the Post's take on it:
>>The use of "fair and balanced" in the title and the resemblance of the cover to the O'Reilly book is "likely to cause confusion among the public about whether Fox News has authorized or endorsed the book and about whether Franken is affiliated with FNC." They are referring, of course, to the large segment of the population that still counts with its toes.<<

The Chicago Tribune reports today that Fox News Network is suing Al
Franken of trademark violation. Franken has published a book with the
phrase "fair and balanced" in the subtitle. In addition, "Fow says
the cover of Franken's book 'mimics the look and style' of two of Fox
host Bill O'Reilley's books." Fox is concerned that "Franken is
'likely to blur or tarnish' Fox News' reputation."
