Explain stand on language policy, govt told

BANGALORE: The high court on Wednesday asked the government to reply
within two weeks its stand on the language policy. Justice
Mohanshantanagoudar ordered notices to the secretary, primary and
secondary department, DDPI, Bangalore North, and commissioner of
Public Instruction on petition filed by Karnataka Unaided Schools
Managements Association and Rajajinagar Education Society, which runs
Aurobindu Vidya Mandir. The petitioners have challenged the February
25 order passed by DDPI rejecting the application for registering as
an English medium school. They cited the 1994 language policy although
the full Bench of the high court had set aside the policy and the apex
court had not issued any stay order on a SLP filed by the state
government.
"The state possesses no power to refuse the registration of an English
medium educational institution. The petitioners, in seeking to
establish educational institutions that impart education in English
medium, are expressing the will of the parents, whose preference for
English medium instruction is their sole prerogative,'' the court
said. When the SC heard the special leave petition on August 29, 2008,
it said parents are not bound by wisdom of international experts in
the matter of education of their children, and that they have a
constitutional right to choose the medium of instruction of their
choice unfettered by opinion of experts. "The apex court merely
directed formal notice to respondents and did not stay the HC order,''
said K V Dhananjay, counsel for petitioners.
