I address this to the linganth list since it might be more widely
useful.
Mieka doesn't raise the Q of who and where she would be recording,
but there is detailed (if possibly slightly out-of-date) info on the
legality of recording, state-by-state and in US federal statutes and
case law,
in the following references:
Murray, Thomas E., and Carmin Ross-Murray. 1992. "On the legality and
ethics of surreptitious recording." Publication of the American Dialect
Society 76: 15-75.
Murray, Thomas E., and Carmin Ross-Murray. 1996. "Under cover of law:
More on the legality of surreptitious recording." Publication of the
American Dialect Society 79: 1-82.
For example, in Virginia "one-party consensual recording" * is permitted
by statute - but of course the callers may not both be in Virginia, and
less
obviously what constitutes an "intercepting device" or an act of
"interception"
under law is not straightforward, etc. etc. Obviously, too, since this
law has
all developed out of "wiretap law", any wireless device (mobiles etc)
may be
treated differently under law.
* "One-party consensual recording" generally means that at least one
person
(usually, in the linguist's case, the linguist or other fieldworker
recording
a call in which they participate) knows it is being recorded. Different
laws
apply in different states and to different situations. It's all quite
complicated,
really, but well worth knowing about in some detail!
