I am a graduate student at Syracuse University, and for my class in
Bilingualism/Multiculturalism my research project is to review judicial
cases involving outcomes that were influenced by language issues
since 2004 and analyze the judicial justifications. If you can suggest
how to locate this type of case, it would be very helpful.
The primary focus of my project will be to review case histories where
the outcomes have hinged upon language issues. Discrimination is
expected to be the legal category associated with the cases and laws
protecting National Origin Discrimination are likely to be those most
frequently referenced. My overall goal will be that of analyzing judicial
rulings since 2004 and comparing them with cases from between 1964
and 2003 to detect whether the justifications utilized by judges
previously in passing down their decisions continues, or if perhaps a
paradigm shift may have appeared on the horizon and/or whether
judges understanding of language issues have succumbed to any
linguistically based enlightenment.
It would be most helpful to obtain the judges' explanation of decisions
made.
