"Judicial activism" and "judicial activist" are important terms in U.S. law and politics but are not in the OED. Below are the earliest uses I have found for these terms:
1946 Buffalo Evening News 26 Dec. 14/1 (Newspapers.com) The real split, he [Arthur M. Schlesinger, Jr.] says, is between "judicial activists" who would employ the judicial power affirmatively for their own conception of the social good, and the "champions of self-restraint."
1947 Arthur M. Schlesinger, Jr. in Fortune Jan. 77 Robert Jackson's ... Book, The Struggle for Judicial Supremacy, sets forth the argument on the historical record against judicial activism.
